ScribeLab Terms of Service

1. Acceptance of Terms

By accessing, registering for, or using any part of ScribeLab's services, website, or applications (the "Service"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree to these Terms, you are prohibited from using or accessing the Service.

These Terms constitute a legally binding agreement between you and ScribeLab ("ScribeLab," "we," "us," or "our"). The Service is owned and operated by ScribeLab.

2. Modifications to Service and Terms

  • Right to Modify: We reserve the right, at our sole discretion, to modify, suspend, discontinue, or restrict the Service, any features, benefits, or content at any time, with or without notice. This includes but is not limited to changes to subscription plans, pricing, essay limits, features, or access to content.
  • No Liability: We shall not be liable to you or any third party for any modification, suspension, discontinuation, or restriction of the Service or any part thereof.
  • Right to Amend Terms: We may revise these Terms at any time by updating this page; the most current version will always be available on our website. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

3. User Accounts and Registration

To access certain features, you must register and create an account. You agree to provide accurate, current, and complete information and to promptly update it as necessary.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use or security breach.

4. Payment, Fees, and Billing

  • Academic Integrity: The Service is intended solely as a research and writing aid. You are solely responsible for ensuring your use of the Service complies with your academic institution's policies, including but not limited to rules on plagiarism and academic honesty.
  • Content Use: The Service is not a substitute for your own work. Proper citation and attribution of generated content are your responsibility.

6. Intellectual Property

The Service, including all content, software, and materials, is owned or licensed by ScribeLab and is protected by copyright, trademark, and other intellectual property laws.

Except as expressly permitted, you may not reproduce, modify, distribute, create derivative works of, publicly display, or otherwise exploit any portion of the Service without our prior written permission.

7. Content Ownership and License

  • User Content: You retain ownership of content you create using the Service. By using the Service, you grant ScribeLab a worldwide, non-exclusive, royalty-free license to store, use, reproduce, display, and process such content to provide, improve, and secure the Service.
  • No Guarantee of Undetectability: While we may offer features designed to make AI-generated content less detectable, we make no representation or warranty that content will not be identified as AI-generated by third parties. You bear all risk and responsibility for use of generated content.
  • Monitoring: We reserve the right (but have no obligation) to monitor, review, or remove user content at our sole discretion.

8. Prohibited Conduct

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Generate, upload, or transmit any material that is illegal, harmful, defamatory, obscene, harassing, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Engage in academic dishonesty, plagiarism, or submit generated content as your own original academic work where prohibited.
  • Interfere with or disrupt the Service, its servers, or networks.
  • Attempt to gain unauthorized access to any part of the Service or accounts of other users.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT ANY CONTENT WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SCRIBELAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR USE, EVEN IF SCRIBELAB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SCRIBELAB'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless ScribeLab and its affiliates, officers, directors, employees, licensors, and agents from and against any claims, losses, damages, liabilities, judgments, fees, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your violation of these Terms, (b) your use or misuse of the Service, (c) your violation of any law or third-party rights.

12. Term, Suspension, and Termination

  • These Terms remain in effect while you use the Service and until terminated by either party.
  • We may, in our sole discretion and without liability, suspend or terminate your access to the Service, or any portion thereof, at any time, with or without notice, for any reason, including for violation of these Terms.
  • Upon termination, your right to use the Service will immediately cease, and ScribeLab may delete your account and content as permitted by law.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [YOUR JURISDICTION], without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located within [YOUR JURISDICTION], and you consent to personal jurisdiction and venue in such courts.

No waiver by ScribeLab of any term or condition shall be deemed a further or continuing waiver of such term or any other term.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ScribeLab regarding the Service and supersede all prior agreements or understandings.
